1) Overview

Welcome to MTN Outfitter (EGN Group LLC dba MTN Outfitter) (“MTN Outfitter,” “we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of our website, content, features, tools, products, and services (collectively, the “Services”). Our store is hosted on Shopify, which provides the e-commerce platform. By using the Services, you agree to these Terms and our Privacy Policy (the “Privacy Policy”). If you do not agree, do not use the Services.

2) Eligibility & Accounts

You represent that you are the age of majority in your state of residence (or have parental consent for any minor dependents using the Services on your devices). You may be asked to provide information (e.g., email, billing, payment, and shipping details). You warrant such information is accurate and that you have the right to provide it. You’re responsible for safeguarding your account credentials and all activity on your account.

3) Products & Content

We strive to display products accurately, but colors/appearance can vary by device and settings. Descriptions, images, availability, and pricing may change without notice. We may limit quantities or discontinue products at any time and may limit sales by person, region, or jurisdiction.

4) Orders

Your order is an offer to purchase. We may accept or decline any order at our discretion. We must receive and process payment before acceptance. If we change, decline, or cancel an order, we’ll attempt to notify you using the contact details provided. Returns and exchanges are governed by our Return & Refund Policy.

5) Prices, Taxes & Billing

Prices, discounts, and promotions may change without notice. The price charged is the price in effect at the time of purchase and shown in your confirmation email. Unless stated otherwise, prices exclude taxes, shipping, handling, customs, and import fees. You agree to provide current, complete billing information and authorize us (and our processors) to charge your selected payment method for all amounts due.

6) Shipping & Delivery

Processing times, shipping methods, and delivery estimates are described in our Shipping & Delivery Policy (see store policy page). Title and risk of loss transfer to you when we deliver an order to the carrier. We are not liable for delays outside our control.

7) Intellectual Property

The Services (including text, graphics, images, video, audio, design, logos, and trademarks) are owned by MTN Outfitter or our licensors and are protected by law. You may use the Services only for personal, non-commercial purposes. No license or rights are granted except as expressly provided. Shopify and other third-party marks are the property of their respective owners.

8) Third-Party Tools & Links

We may provide access to tools or content from third parties. We do not control and are not responsible for third-party sites, tools, policies, or practices. Your use of any third-party tool or link is at your own risk; review their terms and policies.

9) Reviews, Feedback & Submissions

If you submit reviews, ideas, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and display such Feedback in any medium for any purpose. You represent you own/hold rights to your Feedback and that it complies with these Terms and applicable law. We may monitor, edit, or remove content at our discretion.

10) Accuracy, Errors & Omissions

Information on the Services may contain errors or omissions (e.g., product descriptions, pricing, promotions, shipping charges, transit times, availability). We may correct or update information or cancel orders if any information is inaccurate at any time without prior notice.

11) Prohibited Uses

You agree not to use the Services: (a) for unlawful purposes; (b) to violate any laws; (c) to infringe IP or privacy rights; (d) to harass, defame, or harm others; (e) to transmit malware or malicious code; (f) to send spam or misleading content; (g) to scrape or mine data; (h) to interfere with security features or the proper operation of the Services. We may suspend or terminate access for violations.

12) Termination

We may suspend or terminate your access to the Services at any time for any reason, including if we believe you’ve violated these Terms. You remain responsible for amounts due through the termination date. Sections intended to survive (e.g., IP, Feedback, Disclaimers, Liability, Indemnity) will survive termination.

13) Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED BY MTN OUTFITTER, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that results will be accurate or reliable. Some jurisdictions do not allow limitations on implied warranties; some limitations may not apply to you.

14) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MTN OUTFITTER AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS/REVENUE/GOODWILL/DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. In all cases, our total liability shall not exceed the amount you paid for the product(s) giving rise to the claim or $100, whichever is greater. Some jurisdictions limit liability exclusions; some limitations may not apply to you.

15) Indemnification

You agree to indemnify, defend, and hold harmless MTN Outfitter and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Services, your breach of these Terms, or your violation of law or third-party rights.

16) Assignment

You may not assign or transfer these Terms or any rights/obligations without our prior written consent. We may assign or transfer these Terms without restriction.

17) Governing Law & Venue

These Terms are governed by the laws of the State of Montana and applicable U.S. federal law, without regard to conflicts of laws principles. You and MTN Outfitter consent to exclusive jurisdiction and venue in the state and federal courts located in or nearest to Musselshell County, Montana.

18) Severability; Waiver; Entire Agreement

If any provision is held unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remainder will remain in effect. Our failure to enforce a provision is not a waiver. These Terms (together with policies referenced herein, including the Privacy Policy and store policies linked on our site) constitute the entire agreement between you and MTN Outfitter and supersede prior agreements regarding the Services.

19) Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date indicates when changes were made. Material changes will be posted on this page (and, where required by law, we will provide additional notice). Your continued use of the Services after changes take effect constitutes acceptance.
